REGIONAL SPONSORED MIGRATION SCHEME 494 VISA

The Regional Sponsored Migration Scheme 494 visa is a provisional residency visa. It is designed for skilled workers who wish to live and work in Australia’s regional areas. Unlike the 491 visa, applicants for the 494 visa need sponsorship from an employer. The visa is also subject to a SAF Levy.

The Skilled Sponsored (Regional) (Subclass 494) visa allows employers in regional areas to sponsor employees and their families. A broad spectrum of occupations is included. These occupations help address regional skills shortages and attract migrants with diverse skills, experiences, and expertise. As of November 16, 2019, the 494 visa replaced the previous 187 (RSMS) visa.

The 494 visa imposes a 45-year-old age limit, with certain exemptions. It also requires competent English, RCB advice, and compliance with the AMSR. Applicants must have a suitable skills assessment and at least 3 years of experience in their occupation.

Employees using standard business sponsors can also benefit from this program. No additional steps are required for existing sponsors wishing to sponsor subclass 494 visa holders.

Advantages of the 494 visa:

  • Eligibility to apply for permanent residence via the subclass 191 visa (if eligible).
  • A cost-effective option for employers with only one SAF levy stage for nomination.
  • This visa can be cancelled under section 116 of the Migration Act if the visa holder does not genuinely intend to perform the nominated occupation or if the position is no longer genuine.

Pathway to Permanent Residency

The subclass 191 Permanent Residence (Skilled Regional) visa is available for those who meet the requirements. Applicants must have held a subclass 491 or 494 visa for at least three years. They must also meet all visa conditions and minimum taxable income requirements.
