Child 101 & 802 VISA

The Child Visa Subclass 101 or 802 is intended for children who have a parent who is an Australian citizen, a permanent resident, or an eligible New Zealand citizen. These visas enable such children to reside permanently in Australia. The key difference between the two is that the 101 visa is for applicants outside Australia, while the 802 visa is for those already in the country.

In terms of sponsorship, these visas differ from others in that they require sponsorship by an eligible parent. An eligible parent is defined as a parent (or their partner), or step-parent of the child who is over the age of 18 and is a settled Australian citizen, a permanent resident, or an eligible New Zealand citizen. The Department also allows step-parents who no longer have a partnership with the child’s parent but have a legal responsibility for the child under 18, as well as adoptive parents who adopted the child before they became an Australian citizen, a permanent resident, or an eligible New Zealand citizen, to sponsor the child.

To be eligible for either a 101 or 802 visa, you must

  • Have an eligible sponsor
  • Be single
  • Be one of the following:
    • Under 18 and not adopted
    • Under 18 and adopted
    • Between 18 and 23 and a full-time student
    • 18 or older with a disability that prevents them from working and dependent on their sponsoring parent
  • Meet specific health requirements and, if over 16, certain character requirements

Frequently Asked Questions

What is the difference between Subclass 101 and Subclass 802 Child Visas?
Subclass 101 is for children applying from outside Australia, while Subclass 802 is for those already within Australia. Both visas allow eligible children to live permanently in Australia with their parent.
Who can sponsor a child for these visas?
An eligible sponsor must be the child’s parent, step-parent, or adoptive parent who is over 18 and an Australian citizen, permanent resident, or eligible New Zealand citizen. In some cases, a step-parent without a current relationship with the child’s parent may still qualify if they hold legal responsibility for the child.
What are the eligibility criteria for the Child Visa Subclass 101 and 802?
The child must be single and either: under 18 (adopted or not), aged 18–23 and a full-time student, or 18+ with a disability that prevents them from working and dependent on their sponsoring parent. Health and character checks also apply.
Can a child stay in Australia while their visa is being processed?
Yes. If the child is applying from within Australia on a Subclass 802 visa, they will usually be granted a bridging visa that allows them to stay and work until a decision is made.
